5. OUR REVIEW AND ACTION PROCESS

Upon receipt of a valid and complete DMCA Notice, RIPSHOES LLC will:

• Expeditiously remove or disable access to the allegedly infringing material.
• Notify the individual or department responsible for the content that the material has been removed.
• In certain cases, we may provide the opportunity for the content uploader to submit a “Counter-Notification” if they believe the material was removed by mistake or misidentification.

6. FALSE CLAIMS AND FRAUDULENT NOTICES

Important Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney’s fees. Do not submit a DMCA notice if you are not the rightful owner or authorized representative, as you could be held legally responsible for any damages incurred by RIPSHOES LLC or our users.

7. REPEAT INFRINGER POLICY

RIPSHOES LLC takes intellectual property violations seriously. We reserve the right to terminate the accounts of users, or cease business with suppliers and partners, who are found to be “repeat infringers.” We define a repeat infringer as any user or entity that has been notified of infringing activity more than twice.
